Terms of Service
The content below has been extracted from my standard creative services contract. (Ew, legalese!)
By commissioning me through this sale, you agree to the following terms:
Creative Services Agreement
1. INTRODUCTION – The word “Designer” in these terms refers to me, the designer – Brianna Reed (Nerdette Designs LLC) – and the word “Client” refers to you. The word “Agreement” refers to the Creative Services Agreement terms that you are currently reading.
2. PAYMENT – Project quote will be provided via email. All invoices will be generated in Paypal by the Designer and paid via Paypal. Invoices will be billed and sent to the Client’s email address, which shall be provided through the order form.
3. PAYMENT DISCLAIMER – Project work does not begin until the Designer receives the down payment, and final source files will not be sent to the client until after the final payment is made. Final payment should be paid within 30 days that the final payment invoice is sent. If the final payment invoice is not paid within 30 days, an additional 20% late fee will be added to the total of the final payment invoice. If the final payment invoice is not paid within 60 days, legal action may need to be taken, via use of an attorney or a collections agency. If hiring an attorney or collection agency is necessary to collect an invoice, all legal fees will be charged to the Client in addition to the late invoice.
4. REFUND POLICY – Clients may only request a refund from the Designer if the project has been canceled before design work begins. If design work has already begun, then the payment is non-refundable. All refunds will be processed within 30 days.
5. PRODUCTION SCHEDULE – Production schedule and deadlines will be discussed with the Client via email.
6. DEADLINE TERMS – The Designer shall not incur any liability or penalty for delays in the completion of the project due to actions or negligence of the Client (such as delays in communication, via email, phone, or otherwise), unusual transportation delays, unforeseen illness or injury, death of a loved one, or external forces beyond the control of the Designer (such as a computer breaking, a house fire, etc). If such event(s) occur, it shall entitle the Designer to extend the completion/delivery date, by the time equivalent to the period of such delay. Any delays should be reported to the Client as timely as possible.
7. PROJECT OWNERSHIP – All services provided by the Designer under this Agreement shall be for the use of the Client. Upon full payment of all expenses, the Designer hereby licenses all intellectual property rights exclusively to the Client with full usage and modification rights for both personal and commercial use.
Upon project completion, the Designer reserves the right to display the project deliverables as an example of their design work in publications (such as a portfolio, social media post, etc).
8. CONFIDENTIALITY – During the course of this Agreement, it may be necessary for the Client to share proprietary information, including trade secrets, industry knowledge, and other confidential information, to the Designer in order for the Designer to complete the services and deliverables in their final form. All correspondence and documents provided will be treated as confidential between the Client and the Designer, unless written consent has been granted by both parties involved.
9. DISCLAIMER OF WARRANTIES – The Designer shall complete services for the Client’s purposes and to the Client’s specifications. The Designer does not represent or warrant that such deliverables will create any additional profits, sales, exposure, brand recognition, or the like. The Designer has no responsibility to the Client if the deliverables do not lead to the Client’s desired results.
10. AGREEMENT MODIFICATIONS – Modifications to this Agreement document may be made if they are written and sent to the Designer for authorization. Once both parties have agreed on the Agreement modifications, a new version of this Agreement will be sent to the Client to be signed and approved. Once that occurs, this version of the Agreement will be automatically terminated.
11. ACCEPTANCE OF TERMS – The Client shall indicate agreement to these terms when signing the order form.

How long will the sale be running?
50% OFF – December 5th – 18th, 2023
25% OFF – December 19th, 2023 – January 1st, 2024
Rates will be back to 100% starting January 2nd, 2024.
I’m not sure which package is the best for me. Can you help me decide?
Yes, absolutely! Send me an email at bri@nerdettedesigns.com and I will help you choose, or we can even put a custom order together. (Discount still applies!)
How long will my commission take?
It depends on what you order, but most of my projects take a few weeks to complete. If you have deadline concerns, please discuss them with me via email – bri@nerdettedesigns.com.
What happens after I fill out the form?
You can read up on my full design process on this page, but generally:
- Once you’ve filled out the form, I receive a notification via email.
- I will email you within 24-48 hours to confirm that I received your form entry and let you know when I will be sending you more onboarding information (usually within 1-3 days).
- We will discuss further project details, as needed, as well as a finalized project quote (if what you’ve requested is different than one of the service packages).
- I send you a 50% downpayment invoice via Paypal, which can be paid online.
- I send you a confirmation email to let you know I received the payment and when to expect first drafts. (Usually within 1-2 weeks.)
- I send you the first design drafts and we exchange emails back and forth on revisions, as needed.
- Once the designs are finalized and approved, I will send a 50% final payment invoice.
- Once the final invoice is paid, I will send you your design files.
Do you draw emotes?
At this time, no. Emotes require a different skillset, and I prefer to focus on what I’m good at, which is branding and graphic design. If you need help finding an emote artist, though, I can get you some referrals.
Can I sell my logo design on merch (t-shirts, stickers, etc)?
Yes! You will have full reproduction rights for both personal and commercial use, including merch sales. Additional fees are not required for these rights.
What kind of file formats do you provide?
PSD (Photoshop), transparent PNG, and SVG (vector) are standard, but if you have any other file type needs please let me know during our email exchange. All files are high-resolution and will be made print ready, where applicable.
Am I able to edit the files myself?
I am always happy to provide you with editable design files, in one or more of the following formats: PSD (Photoshop), Canva, or Google Slides. Please let me know via the order form (or via email) so that I can get you the file format that is most convenient for you.
What if I don’t like the design(s) you make for me?
This is honestly an extremely rare occurance, but in the event that you are not happy with your design, please be honest with me as soon as possible. (I’ve been doing this for 15 years so I’m thick skinned, I promise. 😉) I want to make sure you like what you’re paying for, so let’s collaborate and make sure that happens!
